The Parish Council recently submitted an application to register the Tyler’s Kiln pub as an Asset of Community Value. This has now been agreed by Canterbury City Council. The the benefits of this are listed in italics below.
This was done to register the importance of the pub as a village amenity.
Please note that the owner can object to the listing and they may request a review of the decision. A written request must be made within 8 weeks of the owner receiving written notification from the Local Authority of the decision to list the asset.
The Parish Council have no further information as to the reopening of the pub.
Consequences of listing
1. The owner of a listed property must notify the Local Authority should they decide to sell the asset.
2. The local authority will notify the community which triggers a 6 week period within which community groups can express an interest in purchasing the asset (this is known as the Interim Moratorium)
3. If no such interest is expressed during the Interim Moratorium then the owner can sell the asset to whoever they choose.
4. An expression of interest during the Interim Moratorium will trigger a longer period, 6 months from the owner’s notice of intention to sell, known as the Full Moratorium.
5. During the Full Moratorium, the owner can only sell to a community group. The intention is that during this period the community group will prepare a business plan and arrange finances in order to put forward an offer to the owner. There is no obligation on the owner to accept any such community offers during this period.
6. If at the end of the Full Moratorium, a community group has not put forward an offer which is acceptable to the owner, then the owner may sell to whoever they choose.
